Terms of Service/ Warranty

BirdsByUs warrants that, at the time of pickup, the bird(s) herein referenced are in good health. BUYER is encouraged to have the birds examined by a certified avian veterinarian of his/her choice within seventy-two (72) hours from time of pickup to verify health of the birds. If, during this 72 hour period, the birds are found to have a condition which affects their health or well-being as determined by the examining veterinarian, then upon verification of this condition to BirdsByUs and upon RETURN of the birds by BUYER to BirdsByUs, BirdsByUs agrees, at his sole discretion, to either refund the entire purchase price to buyer as herein referenced or to supply BUYER with other birds of the same species, sex (if known), age, and monetary value. Veterinary costs are the responsibility of the BUYER and will not be refunded by BirdsByUs. Should BUYER decide to return bird(s) for any reason not related to the health/wellness of a bird, BUYER understands that there will be no refund of any monies and no exchanges for other birds. In the event BUYER fails to have birds herein referenced examined by a certified avian veterinarian within the seventy-two (72) hours after pick-up, then BUYER understands and agrees that the sale is on “as is” condition. BUYER understands and agrees that seventy-two (72) hours after receipt of the birds, all warranties of health, fitness, merchantability, personality trait and pet potential, whether expressed or implied by law, are hereby expressly and voluntarily waived by BUYER. All risks as to the quality and/or performance of the birds referenced herein is with the BUYER and BUYER assumes all risk and cost of injury, death and treatment for the birds seventy-two (72) hours after receipt thereof.
